What Does the DOT Urine Collection Procedure Cover?

What Must Happen Before the Collection Begins?

Before the donor arrives, the collection site must be properly configured. Under § 40.61, the collector is responsible for ensuring the site is secured against tampering and substitution:

  • Bluing agent in the toilet — Add toilet bluing agent to the tank or bowl to prevent the donor from using toilet water to dilute or substitute the specimen. If the toilet does not have a tank (e.g., a flush-valve toilet), ensure the bowl water is visibly blue.
  • Secure water sources — Turn off or tape over the sink faucet and any other accessible water sources in the collection area. If the faucet cannot be turned off, the collector must directly observe the collection.
  • Specimen collection cups — Have the correct DOT-approved single-use specimen collection container ready. The container must have a temperature strip capable of reading the 90°F–100°F range.
  • Federal CCF — Have a current, unaltered Federal Custody and Control Form ready. CCFs must be current-edition forms supplied by or approved by the employer’s MRO or TPA. An expired or altered CCF is a fatal flaw.

No collection may begin until the site is properly secured. Starting a collection in an improperly prepared site — even accidentally — can invalidate the specimen.

Step 1 — Donor Identification

Under § 40.61(a), the collector must verify the donor’s identity before proceeding with any collection steps. Acceptable forms of identification include:

  • Government-issued photo ID (driver’s license, state ID card, passport, military ID)
  • Employer-issued photo ID badge
  • Positive identification by an employer representative — an authorized DER (Designated Employer Representative) may vouch for the donor’s identity in person at the collection site

If the donor has no acceptable ID: The collection cannot proceed until identity is verified. Contact the DER. The DER may come to the site to make the positive ID, or the donor may be sent away and rescheduled. Document the situation in the remarks section of the CCF. Do not collect a specimen from an unidentified donor under any circumstances.

Step 2 — Pre-Collection Instructions

Once identity is confirmed, instruct the donor to prepare for the collection (§ 40.61(b)–(c)):

  1. 1Remove outer garments. Instruct the donor to remove coats, jackets, coveralls, or other bulky outer clothing and leave them outside the collection area. This prevents the donor from concealing substitution devices.

Step 3 — Specimen Provision

  • The collector must listen for sounds of normal urination and remain attentive to any unusual noises (running water, extended silence, etc.) that might suggest tampering.

  • Once the donor exits, they must hand the specimen container directly to the collector. The collector takes immediate custody. Do not allow the donor to set the container down unobserved.

Step 4 — Temperature Check

The temperature check is one of the most critical steps in the DOT collection procedure and must be performed immediately after receiving the specimen (§ 40.65):

Temperature window:

90°F – 100°F (32°C – 38°C)

Must be checked within 4 minutes of the donor providing the specimen. Read the temperature strip on the outside of the collection container.

If the temperature is within range: Proceed with the collection. Note the temperature reading in Step 2 of the CCF.

If the temperature is out of range (below 90°F or above 100°F): You must immediately offer the donor the opportunity to provide a second specimen under direct observation. Check the “temperature outside range” box on the CCF and document what you observed. The out-of-range specimen is not discarded — send both the original and the observed specimen to the lab, each with its own CCF, marked accordingly. The MRO will determine the final result. Do not let the donor leave without giving them the opportunity for the observed recollection.

Step 5 — Split Specimen Processing

Once the temperature check confirms the specimen is within range, immediately process the split specimen in full view of the donor (§ 40.67):

  1. 1Pour a minimum of 30 mL into Bottle A (primary specimen). Bottle A must be filled first. This is the specimen the laboratory will test.
  2. 2Pour a minimum of 15 mL into Bottle B (split specimen). This specimen is held in reserve and is only tested if the donor or employer requests a split retest after a non-negative result.

Step 6 — CCF Completion

  • Collector completes Step 2 — Fill in the collection date, collection site address, specimen ID number, temperature reading, and reason for test. Check the appropriate collection type box (single vs. split). Sign and print your name in the collector certification block, certifying that you are a qualified DOT collector and that the collection was performed according to 49 CFR Part 40.
  • Collector completes Copy 4 and Copy 5 — Copy 4 is the laboratory copy (stays with the specimen). Copy 5 is the donor copy.
  • Donor signs Copy 5 (Step 5) — The donor reads and signs the donor certification statement on Copy 5, certifying that the specimen identified is theirs and was provided to the named collector. The donor must sign before leaving. If the donor refuses to sign, document the refusal on the CCF — this is not a reason to cancel the collection.
  • Give Copy 5 to the donor — The donor leaves with their copy. This is the only copy they receive. Do not give the donor any other CCF copies.

Step 7 — Specimen Shipping

Once the donor has left, package and ship the sealed specimens to the HHS-certified laboratory (§§ 40.111–40.115):

Which Errors Invalidate a DOT Collection Under 49 CFR Part 40?

Part 40 defines two categories of CCF and collection errors: fatal flaws (which require the laboratory to reject the specimen) and correctable flaws (which can be fixed via memorandum of correction within 5 business days). The following collection errors are serious enough to result in specimen rejection or removal of the collector from the qualified list:

1. Temperature out of range — not documented

Failing to check the temperature within 4 minutes, or failing to document an out-of-range temperature and offer the donor an observed recollection, is a fatal procedural error.

2. Broken or incomplete tamper-evident seal

If the laboratory receives a specimen with a broken, missing, or improperly applied seal — or a seal without the donor’s initials — the specimen must be rejected as a fatal flaw.

3. Missing donor signature on Copy 5

If Step 5 of the CCF (donor certification) is not signed and the collector does not note a donor refusal, this is a correctable error — but only if it can be substantiated within 5 business days. A pattern of missing donor signatures can trigger removal proceedings.

4. Incomplete or incorrect CCF

Missing collector signature, incorrect specimen ID, wrong reason-for-test, or an unsigned collector certification block can constitute fatal flaws depending on which step is missing. The MRO determines whether an error is correctable.

5. Wrong specimen volume

Bottle A containing less than 30 mL at the laboratory (insufficient specimen) results in specimen rejection. Always confirm volume visually before sealing — if volume appears borderline, measure before proceeding.

6. Leaving the donor unobserved during sealing

If the collector or donor leaves the immediate area during the sealing, labeling, or initialing process, chain of custody is broken. The collection must be restarted from the beginning.
